RBI Introduces Secured Overnight Rupee Rate (SORR)
RBI Introduces Secured Overnight Rupee Rate (SORR)

The Reserve Bank of India (RBI) has announced the creation of the Secured Overnight Rupee Rate (SORR), a new benchmark for the interest rate derivatives market. This initiative aims to enhance the robustness, transparency, and reliability of India’s financial benchmarks, aligning them with global standards.

    Key Features of SORR

    • Transaction-Based Benchmark: SORR will be derived from actual secured money market transactions, including market repo and tri-party repo (TREPS), reflecting real market dynamics.
    • Support from FBIL: The Financial Benchmarks India Limited (FBIL) will spearhead the development and implementation of SORR, incorporating feedback from the financial community.
    • Manipulation-Resistant: Unlike the existing Mumbai Inter-Bank Offer Rate (MIBOR), which is derived through polling of market participants, SORR will be trade-based, significantly reducing the scope for manipulation.

    Transition from MIBOR to SORR

    • MIBOR Overview: Introduced in 1998, MIBOR has been widely used in India’s financial markets. However, it is based on polling responses, which raises concerns about its susceptibility to distortion and manipulation.
    • SORR’s Advantages: SORR will provide a more accurate representation of overnight funding rates, covering 98% of the overnight market activity, thus ensuring higher reliability.

It is designed to be transparent, robust, and aligned with global best practices, including the Secured Overnight Financing Rate (SOFR) in the U.S., which replaced LIBOR as a benchmark.

Role of FBIL and Implementation Timeline

    FBIL’s Role:

    • FBIL will develop and operationalize SORR based on the recommendations of the MIBOR Committee.
    • Public consultations and feedback will be accepted until November 15, 2024, to finalize SORR’s design and methodology.

Gradual Implementation: While SORR will be introduced as a new benchmark, the transition from MIBOR to SORR will occur gradually to ensure market stability.

Morgan Stanley Cuts India’s FY25 GDP Growth to 6.3%

Morgan Stanley has revised India’s GDP growth projection for FY25 down to 6.3%, from its previous estimate of 6.7%. This downward revision comes after India’s GDP growth slowed to 5.4% in the July-September 2024 quarter, marking its lowest level since March 2023. This reflects a broader economic slowdown, driven by weaker private consumption and capital expenditure (capex), though the services sector showed resilience. Despite this dip, Morgan Stanley maintains optimism for a recovery in the latter half of FY25, expecting growth to average 6.6%, fueled by government spending, improved rural demand, and easing financial conditions.

Key Points from the Latest Revision

Slowdown in Q2 FY25: India’s GDP growth slowed to 5.4% YoY in Q2, the lowest since March 2023, primarily due to weaker private consumption and subdued capital expenditure (capex).

    • Private Consumption: Grew by 6%.
    • Capex: Lower growth at 5.4%.
    • Services Sector: Expanded by 7.1%, showing resilience.

Industry: Lagged with only a 3.9% increase, driven by declines in manufacturing and electricity generation.

    Monetary Policy and Liquidity Measures

    • RBI’s Role: Interest Rates: The Reserve Bank of India (RBI) is expected to keep interest rates unchanged in its December 6 review, with inflation projected to ease to 5-5.5% in the next two months.
    • Liquidity Measures: The RBI may implement liquidity-enhancing measures like open market operations (OMO) to address tight banking system liquidity.

RBI Lifts Supervisory Restrictions on Navi Finserv
    • On December 2, 2024, the Reserve Bank of India (RBI) lifted the supervisory restrictions imposed on Navi Finserv, a non-banking financial company (NBFC) led by Sachin Bansal.
    • The restrictions were initially imposed on October 17, 2024, due to serious regulatory concerns regarding:
    • Loan pricing practices: Specifically, excessive weighted average lending rates (WALR) and interest spreads charged over the company’s cost of funds.

Non-compliance with the Fair Practices Code.

    • Inadequate borrower assessment processes.
    • Along with Navi Finserv, three other NBFCs — DMI Finance, Asirvad Micro Finance, and Arohan Financial Services — were also subject to similar supervisory measures.

Corrective Measures Taken by Navi Finserv:

    • Revamped loan pricing policies: The company ensured that its loan pricing practices were fair, transparent, and in compliance with RBI regulations.
    • Enhanced borrower assessment systems: Updates were made to ensure thorough evaluations and compliance with the Fair Practices Code.
    • These steps were undertaken in close collaboration with the RBI, and the company worked on reforming its internal processes to meet the required standards.

Banking Laws (Amendment) Bill, 2024 Set To Introduce in the Lok Sabha
Banking Laws (Amendment) Bill, 2024 Set To Introduce in the Lok Sabha

The Banking Laws (Amendment) Bill, 2024 is set to be introduced by Union Finance Minister Nirmala Sitharaman in the Lok Sabha on 2nd December 2024. This bill aims to amend several key banking-related legislations, including:

    • The Reserve Bank of India Act, 1934
    • The Banking Regulation Act, 1949
    • The State Bank of India Act, 1955
    • The Banking Companies (Acquisition and Transfer of Undertakings) Acts of 1970 and 1980

These amendments are designed to enhance the functioning and regulation of the banking sector. Here’s a detailed overview of the key amendments proposed in the bill:

Definition of “Fortnight” for Cash Reserves

Current Definition: A “fortnight” is defined as the period from Saturday to the second following Friday, including both days, used to calculate the average daily balance held by scheduled banks as cash reserves.

Proposed Amendment: The “fortnight” will be defined as:

    • From 1st to 15th day of each month
    • From 16th to the last day of each month

Impact: This change will apply under the Banking Regulation Act as well, where non-scheduled banks are required to maintain cash reserves.

Tenure of Directors of Co-operative Banks

    • Current Rule: Directors (other than the chairman or whole-time directors) cannot hold office for more than eight consecutive years.
    • Proposed Amendment: The tenure will be extended to 10 consecutive years.
    • Impact: This extension is expected to bring greater stability in the governance of co-operative banks.

Prohibition on Common Directors in Co-operative Banks

    • Current Rule: The Banking Regulation Act prohibits a director from serving on the boards of more than one bank, with exceptions for directors appointed by the RBI.
    • Proposed Amendment: The exemption will now extend to directors of central co-operative banks, allowing them to serve on the board of a state co-operative bank if they are a member.
    • Impact: This aims to enhance coordination and strengthen the leadership within the co-operative banking system.

    Substantial Interest in a Company

    • Current Rule: “Substantial interest” is defined as holding shares worth more than ₹5 lakh or 10% of the paid-up capital, whichever is lower.
    • Proposed Amendment: The threshold for “substantial interest” will increase to ₹2 crore.
    • Impact: This relaxation will allow individuals and their families (spouse or minor children) to hold a larger stake without it being considered substantial, benefiting larger investors and corporate entities.

Nomination for Deposits and Bank Products

Current Rule: The Banking Regulation Act allows depositors to appoint one nominee for their deposits, articles, or lockers.

Proposed Amendment: The Bill allows up to four nominees for:

    • Deposits (either simultaneously or successively)
    • Other items like articles and lockers (successively)

Impact: In case of simultaneous nominations, the distribution will be according to the declared proportion, while successive nominations will prioritize the first person listed. This will simplify the distribution of assets and clarify the rights of multiple nominees.

    Settlement of Unclaimed Amounts

Current Rule: Under the State Bank of India Act and the Banking Companies (Acquisition and Transfer of Undertakings) Acts, unpaid dividends are transferred to an unpaid dividend account, and after seven years, they move to the Investor Education and Protection Fund (IEPF).

Proposed Amendment: The Bill will expand the scope of funds that can be transferred to the IEPF to include:

    • Shares for which dividends have not been claimed for seven consecutive years
    • Interest or redemption amounts for bonds that remain unpaid/unclaimed for seven years

Impact: This will allow individuals to claim unclaimed funds transferred to the IEPF, promoting financial transparency and resolving outstanding claims.

    Remuneration of Auditors

    • Current Rule: The remuneration for auditors of banks is decided by the Reserve Bank of India (RBI) in consultation with the central government.
    • Proposed Amendment: Banks will now have the authority to determine the remuneration for their auditors independently.
    • Impact: This change is expected to streamline the auditing process by reducing bureaucratic involvement in the remuneration process for bank auditors.

It serves as a reminder of the progress made in prevention, treatment, and care, while also highlighting the ongoing challenges in the battle against HIV/AIDS. This observance plays a crucial role in reducing stigma, commemorating those who have lost their lives to AIDS, and promoting Universal Health Coverage (UHC) and the Right to Health for all.

2024 Theme: “Take the rights path: My health, my right!”

The theme for World AIDS Day 2024 emphasizes the importance of human rights in the fight against HIV/AIDS. The campaign advocates for:

    • Equitable access to healthcare services for everyone.
    • Empowering individuals to exercise their right to health.
